While the problems between the tenants and the landlords who buy a house while there are tenants in it have increased recently, the famous oriental Didem Kınalı has been in court with its tenant.
Oryantal Didem Kınalı bought a duplex flat with a tenant in Beyoğlu, Cihangir on 21 December 2021. Since the flat in question consists of two independent and different sections, the tenant, Fatma Eser E., saw that although she rented the independent section number 5, the other independent section number 6 was included in the usage area in violation of the lease agreement.
DID NOT evacuate the independent section
Thereupon, Didem Kınalı asked tenant Fatma Eser E. to vacate the independent section numbered 6. However, the tenant stated that he would not vacate the flat and continued to share 2 thousand TL as the rent. Thereupon, Didem Kınalı, through her lawyer Ebru Sarıtaş, filed a lawsuit for the re-determination of the rental price at the Istanbul Civil Court of Peace.
THE TENANT COMBINED TWO FLATS
In the petition, it was stated that “The tenant has combined two separate apartments that are independent from each other in violation of the lease agreement and interfered with our property right by creating a single use area”.
DAILY RENTAL CLAIM
In the petition, in which it is claimed that the tenant earns by renting the independent part occupied by internet applications to third parties on a daily basis, the current rental prices are 10-15%. In Cihangir, where there is 1,000,000 TL, it is not possible to rent 2 thousand TL, and it was requested to determine the rental value as 10 thousand TL.

Oriental Didem said, “There were two independent sections in the real estate I bought in Cihangir. The person I bought the house from said that the tenant’s contract expired in May . I said I would live on the top floor. But the tenant occupied the place. He asked me for money to get out. I also pay the rent and pay the other loan for the house I bought. I am a victim,” he said.
